Try at Home Agreement
This Try at Home Agreement (this “Agreement”) is a legal agreement between you, the customer, (“you” or “your”) and Avery Austin Corporation (“Avery Austin,” “we,” or “us”), establishing the terms and conditions under which you will try on wedding dresses, bridesmaids dresses, dresses, accessories, and other items (each a “Product” or “Products”) and receive related services from us through our website at averyaustin.com.
Before you click on the “Pay now” button, carefully read this Try at Home Agreement. By clicking the “Pay now” button, you are agreeing to be bound by and are becoming a party to the Agreement. If you do not agree to all the terms of this Agreement, you will not be permitted to try-on Products from Avery Austin.
The following policy applies to try at home orders only. Try at home orders are those that are checked-out as "Try at Home" on our website.
This Agreement contains all the terms and conditions governing your try-on of Products from Avery Austin through our Site. You agree that your use of the Site and your try-on of Products is subject to our website Terms & Conditions of Use and our Privacy Policy, as such terms may change from time to time. You agree and acknowledge that you are trying on the Products and that ownership of the Products remains with Avery Austin at all times.
Try at Home Fees and Credit Card Authorizations
The Try at Home fee ("Try On Fee") for the Products will cover the Try On Fees, taxes and any other associated charges detailed on the checkout page of our website in connection with your Try at Home order made via your account. Upon placing your order for Products, you authorize us to charge your credit card for the Try On Fee. We will charge your credit card the amount of the Try On Fee immediately upon you clicking “Pay now” on our website. You represent that you are authorized to use the chosen payment method (including, without limitation, credit cards) for the purpose of trying on the Products as described herein. In addition to the Try On Fee, you further authorize us to charge your credit card for any “Unreturned Fee,” or other damage amounts as set forth below.
Shipping
Your Try at Home order will be shipped to you through a shipping partner, and will be scheduled to arrive an estimated 7 business days after placing the order. We only ship to a verified United States Postal Service residence, office or hotel street address within the continental US (we cannot ship to a P.O. Box). All orders are shipped in a high-quality corrugated box.
Returns
To return your Try at Home products, pack everything back into the original box. Use the return label included inside your Try at Home box and take the box to your nearest Fedex drop off location. We do not ship outside of the contiguous US, nor do we permit orders to be returned from outside of the contiguous US. If your Try at Home order is returned from Alaska, Hawaii, or an international country, we do not reimburse for extra shipping costs and international shipping costs.
Unreturned Fees
All Try at Home orders must be shipped back to Avery Austin no later than 7 days after the order is delivered. If you would like additional time with your Try at Home order, contact our customer service team for an extension. If Try at Home item(s) are not returned within ten (10) days from the date of delivery, they will be considered unreturned. In that case, Avery Austin reserves the right to charge your payment card a $300 fee per item, applied toward the Full Retail Value of each gown as listed on the website and your Try at Home Agreement order line item, plus applicable sales tax. A separate invoice will be issued for the remaining balance of the Full Retail Value.
You will be responsible for Unreturned Fees and any other damage charges collectively associated with Products you ordered and for any orders for Products initiated from your account. If you do not pay the amounts you owe to us when due, then we will need to institute collection procedures. You agree to pay our costs of collection, including without limitation reasonable attorneys' fees.
Damages
Every dress is quality checked and inspected before being sent out. Try at Home item(s) should be returned in the condition they were received. If we determine that a Try at Home product is returned with damage or excessive wear (including stains, odors, or other signs of misuse), a cleaning or damage fee may apply. If a Try at Home product is not returned, you will be charged an Unreturned Fee for the item.
Buy your Try at Home Dress
In addition to our Try at Home service, we're offering the option to purchase try at home items at 15% off. For items that qualify for purchase, you will find information in your try at home box on how to purchase the item, or go to averyaustin.com/pages/buy-sample-dresses. All sales are final and “as is”. The option to keep your Try on product is not available for all styles.
Limitation of Liability
The full extent of Avery Austin’s liability to you under this agreement is governed by our website Terms & Conditions of Use and our Privacy Policy, which are hereby incorporated into this Agreement.
No Warranty
We do not make any representations or warranties about the Products and all disclaimers set forth in the Terms & Conditions of Use will apply to the products and any other activities under this agreement.
